Hong Kong SAR - Corporate - Withholding Taxes





HK Withholding Tax on Royalties


Hong Kong SAR imposes a withholding tax on certain royalty payments made to non-residents. However, there are no withholding taxes on dividends or interest payments.   


Withholding Tax on Royalties:


  • General Rate: The withholding tax rate on royalties paid to non-resident corporations is generally 16.5%. However, the rate is reduced to 8.25% for the first HKD 2 million of assessable profits.

  • Concessionary Rate: In certain cases, a concessionary rate of 2.475% to 4.95% may apply, subject to specific conditions.   

  • Deemed Profits: If the non-resident recipient is not subject to Hong Kong SAR profits tax, a deemed profit of 30% of the royalty is subject to tax, resulting in an effective withholding tax rate of 4.95%.
